These Terms of Use form the agreement between you and Ham AI (fxham.com) covering access to this website and use of the software and services we provide. By using the website or activating any product, you confirm that you have read, understood and accepted everything below.
1. Acceptance
If you do not agree with any part of these Terms, please stop using the website and the products. These Terms apply together with our Risk Disclosure, Privacy Policy, Cookie Policy and Financial Disclaimer, which form an integral part of the agreement.
2. Definitions
“Ham AI”, “we”, “us” means the operator of fxham.com and the Ham AI branded products. “You”, “user” means the individual or entity using the website or the products. “Products” means the Ham AI GOLD, FX, CRYPTO, INDEX and OIL bots, the live performance board, technical documentation and any accompanying tools. “HAM COPY” is a copy-trading service operated independently of the Ham AI bot system.
3. Eligibility
You must be at least 18 years old and have legal capacity to enter into a contract. You are responsible for ensuring that using the products is lawful where you reside. The products are not directed at users in territories where their supply or use is restricted by law.
4. Accounts and security
Where access is granted to you, you are responsible for keeping your credentials, activation keys and any API keys you create confidential. Activity carried out through your account is treated as your own. Notify us immediately if you become aware of unauthorised access.
Ham AI does not request or store the withdrawal password of your broker account, and will never ask you to transfer funds to an individual member of staff.
5. Software licence
Ham AI grants you a personal, limited, non-exclusive, non-transferable and revocable licence to run the products on your own trading account for the duration of a valid subscription.
The licence does not include the right to resell, rent, distribute or share activation keys, or to provide account-management services to third parties using our software, without a separate written agreement.
6. Prohibited conduct
You agree not to: (a) reverse engineer, decompile, disassemble or otherwise attempt to extract the source code, parameters or trading logic of the products; (b) copy, modify or create derivative works; (c) share activation keys or use one licence across multiple users; (d) attempt unauthorised access, vulnerability scanning, denial-of-service attacks, or any interference with normal operation of the website; (e) use the products for market manipulation, money laundering or any unlawful purpose; (f) carry out large-scale automated data collection without our prior written consent.
7. Nature of the service and no guarantee of results
The products are provided on an “as is” and “as available” basis. Ham AI is analysis and execution-automation software. We are not a broker, we do not manage capital, and we do not provide personalised investment advice.
We do not guarantee profit, do not promise any win rate, and do not warrant that the service will be uninterrupted or entirely free of defects. The safety layers are risk-control measures, not a guarantee against loss. Please read the Risk Disclosure in full.
8. Fees, renewal and refunds
Fees, billing cycles and the scope of each plan are stated at the point of subscription. Unless otherwise agreed in writing, fees paid for a period already used are non-refundable, because the product is software made available immediately on activation.
You may cancel renewal at any time before the next billing date; access continues until the end of the paid cycle. If a technical fault on our side prevents you from using the product for an extended period, contact us and we will consider a compensating extension or a proportionate refund.
9. Intellectual property
The Ham AI name, logo, interface, documentation, source code, models and all website content belong to Ham AI or to our licensors. You may not use our marks or content commercially without written permission.
10. Third-party content and links
The website may display market data, an economic calendar and links to third-party brokers or services. We do not control and are not responsible for their accuracy, availability or policies. A link does not imply endorsement or recommendation.
11. Limitation of liability
To the maximum extent permitted by law, Ham AI is not liable for indirect, incidental, special or consequential damages, including lost profits, lost trading opportunities, data loss or business interruption, arising from use of or inability to use the products.
In any event our total liability to you will not exceed the service fees you paid to Ham AI in the twelve (12) months preceding the event giving rise to the claim. This limit does not apply where liability cannot be excluded by law.
12. Indemnity
You agree to indemnify and hold Ham AI harmless against claims, losses and reasonable costs arising from your breach of these Terms, your breach of law, or your misuse of the products.
13. Suspension and termination
We may suspend or terminate your access if we identify a breach of these Terms, conduct that endangers the system or other users, or where we are legally required to do so. You may stop using the service at any time by disconnecting the product from your trading account.
14. Changes to the service and these terms
We may update features, discontinue components, or amend these Terms to reflect product or legal changes. The version in force is the one displayed on this page. For material changes we will give notice on the website or by email to your registered address.
15. Governing law and disputes
These Terms are governed by the laws of Vietnam. The parties will first attempt to resolve any dispute in good faith within 30 days of written notice. Failing that, the dispute will be submitted to the competent court under Vietnamese law.
16. General
If any provision is held invalid, the remaining provisions stay in force. Our failure to enforce a right at any time is not a waiver of that right. You may not assign your rights or obligations under these Terms without our written consent.
